1. Scope
These terms describe the general operation of service requests made through ShutTheFuckUp.es. The configurator and form are used to request information or a proposal and do not create a contract by themselves.
2. Contract formation
A contract is formed only when PeC issues a proposal, quote, statement of work or equivalent document setting out scope, price and conditions, and the other party accepts it through a method that provides evidence of acceptance.
3. Prices and taxes
Website prices are indicative. Unless expressly stated otherwise, VAT is not included. The final proposal will state applicable taxes, payment terms and any additional costs.
4. Timelines
Configurator timelines are estimates. Final schedules depend on scope, availability, delivery of materials, reviews and required integrations.
5. Client obligations
The client must provide lawful information and materials, hold the necessary rights to them, validate deliverables within agreed timeframes and pay agreed amounts.
6. Scope changes
Features or work not originally included may be quoted separately.
7. Intellectual property
The specific proposal will determine ownership, licensing and delivery of code, designs, content and materials. Third-party components remain subject to their own licences and terms.
8. Maintenance and third parties
Hosting, domains, licences, payment gateways, APIs and other third-party services may be subject to their own terms and fees.
9. Consumers and withdrawal
Where a distance contract is entered into with a consumer and consumer law applies, the statutory 14-day withdrawal right and legal exceptions will be respected. If the consumer asks for a service to start during that period, the legal consequences will apply and, where required, the relevant express consent will be obtained.
10. Specific proposal prevails
If a specific proposal or contract contains different terms, that document will prevail to the extent valid and lawful. Mandatory consumer rights are not limited.
